Recently, our local hospital has implemented a Dunkin Donuts within its main lobby... I have found that there is NO LINE there in the morning and have been going there to get my morning coffee (since the other Dunkin Donuts in town have a wait upwards of 20 minutes).

I normally park in the emergency parking area so I can run in and get my coffee, and up till this morning I have not had an issue. Today, my car was on the 'hooks' of a flat bed and they were moving it on when I came out. I tried to discuss this with the tow truck guy, even offering him a bribe but he REFUSED to take my car off the hooks.
I felt this guy was VERY rude to me and I'm thinking of pressing charges against the tow truck company...I was in that parking spot for less than 2 minutes and he had my car...it was almost like he was waiting for me...

do I have a case against him and my 100.00 impound fee?

Go ahead and take it to court, you'll be laughed out of there. Are you kidding, this can't be a serious question, can it? By now you would think you'd have the idea of "emergency" parking pretty well understood, and a coffee doesn't fall into that category. I'd even bet that you also park in the handy cap parking space when it's convenient for"you".
I don't know how old you are but what ever your age, grow up, think of some one besides yourself.
As far as the $100.00 goes, I hope it was some really good coffee for that price.

a case for what? criminal charges? No way, this is a legally marked no parking/fire lane. The owners of the establishment were empowering a local wrecking company to enforce the posted rules on their property. You say you only run in for two minutes? Well, what is so different about you from everyone else that just runs in for a quick cup of coffee? They all manage to find a legal parking spot. A civil suit? well, anyone can sue anyone else, so go ahead... but will you win? that is highly doubtful.
How about next time park in a regular parking space like everyone else, and not only will your fellow customers not be annoyed with "special" people like you, but god forbid when there is a fire, the equipment will be able to park and go to work instead of waiting precious seconds for the special people to move their cars first.
and by the way, my money is solidly on the fact that it was YOU that was the rude one, not the wrecker operator. This is the usual behavior of you special people, who walk around with an entitlement mentality.

You bet you have a case by all mean go after the company and don't even bother getting a lawyer just tell the judge you were only blocking the ambulance who trying to get the dieing victim to life support systems when they finally freed them from wreckage at the airport off of that airbus that went down. Tell him they could have wasted few more precious while you get your all mighty coffee. It happens time and time again for those of us who have deal with them, that it seems senseless to put no parking Zone.When it finally happens your 100.00 impound fee will seem even less then a drip in the bucket.

It is FINE to park there ... for $100 dollars.

And once they hook your car ... you have nothing to say. What gets real messy is when you were parked legally and they hook you up. You can't get your car back unless you pay, and just try to get that money back. Even if you do take it through the courts its so often a he said she said, which even if you win costs you more in time off work than that.

They don't call them the Lincoln Park Pirates in Chicago for nothing (immortalized in song).

$100 impound fee is actually cheap these days ... I've heard of fees as much as $190.

Oh and don't forget the ticket too ... that will be another $50, $100, ... or more ... some places as much as $350, and even the most sympathetic judge in the world will slam you with the full amount (plus court costs) so just pay it.

Nope. You broke the law. There is no time limit when parking in a restricted zone. There also is no law saying he has to be polite. He's probably contracted through the city, he's not a city employee. Even so, if he said something that had legal grounds it would be your word against his. Basically take this as a $100 lesson and next time park in a legal space and walk the extra distance when getting your coffee. It'd stilll be a lot faster than waiting 20 minutes in line.

I seriously doubt you have a case. You seemed to miss one point: emergercy parking is for emergencies! Were you in a life-threatening situation? No. You were just getting doughnuts. If there is NO LINE in the morning, would it have hurt you to park in an appropriate parking space and walk a little further? It would have been a lot less trouble than what you are dealing with now.

Kick the habit of coffee drinking. This has caused you the trouble. Though you have no case, you can write in to the tow company about the rough treatment you get from its staff. If this will at least reduce you anger. I sympathize you. But would advice you just pay the fine and set your car free. Perhaps you may have a case if your car is not properly handled.

what would you do if you needed that spot in a real emergency and someone was parked there in a non emergency situation and you had to park far away because of it ? how would you feel if that delay cost you a life of your loved one? coffee is not an emergency nor is a donut. don't try to fight it you will get laughed right out of court or even fined a heftier fine for wasting the courts time.

The tow guy was only doing his job too. Ask where you can park to get your donuts without getting a ticket or towed.
I've never heard of such a ridiculous place for a donut shop anyway. Maybe they will put a drive-thru in. Put it in the suggestion box.
