No state is legally permitted to hang their state flag above the American flag.

HOWEVER,

Texas is the only state that can fly a texas flag at the same height as the American flag AND the only state that can fly a Texas flag without being "accompanied" by an American flag.

It is this way because Texas is the only state that fought and won its own indepence from another country in order to become part of the united states.

No state can fly the flag higher than the American Flag - it's not just a Texas thing. Texas is a part of a union of states that make up the United States of America. Therefore, all states are subject to a presiding governing factor (the Federal Government).

The state flag cannot be place higher than the national flag because then you would be giving the impretion that Texas is more important than the whole U.S., this is also why you typically dont place any one state flag over the other because no state is more important than any other. The whole thing just kind of falls under flag etiquette.

The Flag Code states: When flags of States, cities, or localities, or pennants of societies are flown on the same halyard with the flag of the United States, the latter should always be at the peak.

However, this isn't a law and there's no penalty for doing otherwise.

You could have done this, but you'd have to travel back in time before Texas was admitted to the Union.

Until Texas becomes another country, you have to abide by flag protocol and hang the stars and stripes higher.
