What happens when the mother you pay child support to passes away? Should "CS" be contacted> then wait and see who takes custody? Paying father but never meet child.

Child support should continue and be paid into the deceased mother's estate. As she left a surviving dependant, the estate wil go the child, the child's trustee or guardian anyway. Continue to make payments to the executor or the lawyer for the estate to cover your own bum until a determination of guardianship can be made. You will more than likely have to pay the new guardian support.

You can apply for guardianship if you wish to do so. If you do not wish to do so and no relatives are willing or able to care for the child it will become a ward of the state and you will have to pay the state support.

Child support is an issue ordered by the courts. Depending upon who the next custodial parent becomes will determine who the support payments are made to.

Child support NORMALLY continues until the age of emancipation unless there is an order that the payments will continue should the child pursue a college education.

If you stop child support payments against the order of the court...you are subjecting yourself to issues like a "Contempt of Court" for failure to comply with the judges order to make the payments!

I would call them and see what they say. I would think since your the childs father you'd get custody because you obviously didn't sign your rights away if your paying cs. But if you don't want custody i think you still have to pay whoever is taking care of the child unless you sign your rights away.
