If I wanted to divorce my husband, and it was pretty clear I was going to win the case, what are my rights as a canadian but my son is an american? Can I take him out of the country? What about during the divorce or before? What are my rights along whether or not I can take him to Canada, since he's american, if my husband called police would they be able to take him or accuse me of anything, etc etc. I would like to know. Help!

I imagine you are going to get a lot of opinions on this, but really, you need to consult a lawyer about this. If you have legal custody of your son, you should be able to take him anywhere you want. That happens on a daily basis. But, the magic words here are... legal custody. Please see a lawyer for your own peace of mind. Good luck with your child,

WELL IF THE CHILD WAS BORN HERE IN THE UNITED STATES AND HE IS ACTUALLY AN AMERICAN CITIZEN THEN U CANT BY LEGAL MEANS TAKE HIM OUT OF THE COUNTRY , YOUR BEST BET IS TO GO TO COURT AND FILE FOR SOME FORM OF CUTODY BUT U WILL NOT GET 100 PERCENT CUSTODY ITS NORMALLY SHARED DURING THE DIVORCE AND BEFORE HUSBAND CAN PREVENT U FROM TAKING THE CHILD OUT OF THE STATE THAT HE IS LIVING IN , IF U R FILING FOR DIVORCE FROM THE DAD U NEED TO DO SO NOW AND REMAINE IN THE UNITED STATES WELL COURT PROCEDDINGS ARE STILL GOING ONB UNLESS THE JUDGE HAS GIVEN U PERMISION TO TAKE THE CHILD . THE DAD CAN ALSO OREDER OR REQUEST EVEN THOIUGH U R A CANDAIN RESEDINT OR NON AMERICAN CITIZEN THAT U REMAIN IN THE UNITED STATES WITH YOUR CHILD EVEN AFTER THE CUSTODY

All of that will be handled in the divorce by family court. Talk to a lawyer!
