Forget your lawyer, she sees you as a small fish, if she try to intimidate you do not listen, get a new layer, your medical bills are proof that you are not making up numbers from the air. You do not need the tape, in civil courts they are the one that would need the tape to proove the accident never happend. Many accidents happend without a camera filming the accident. Remember this is a civil case not a criminal case, in civil cases the acused must proove the accident didn't happend; the missing tape is bad only for them.

Your lawyer can drop you, but not to let the case die in court, if the case have a near date to be seen, go on advance ask what you should do to delay it until getting a new lawyer (court employees ussualy know how thsing are done in there and most are willing to tell you what to do; just go at a not so busy moment, the less busy they are the more they can help you)

At some areas there are free legal services for people with economic problems; law school some times give free services so that their students can get experience. Check at the layers axamination bar of your state, they have lists of layer for your area.

Lawyer are like any other service giver, do not take for granted that all of them are smarts and professionals; some of them are just idiots, other just greedy bastards, but a few are very honest, itelligent and professionals. Ask other people in simmilar situations, they are the best way to know a good an responsable lawyer, if they felt they were given a good service they'll tell you, if they were given a bad service they'll tell you so.

You got hurt? An injury that required medical attention? An injury that has caused you lost wages? Or your fell down got a boo-boo and moved on with your life after a couple doses of tylenol?

You don't mention the extent of your damages. This is one of the problems with our sue happy environment - everyone thinks they can sue for anything, but if your don't have damages you don't have a case! I fell on my **** out in front of the drug store, and yeah it hurt when I hit the concrete and yes there was ice. I had a bruise - it healed and the manager said he will be more careful with salting the sidewalk. TADA.......I had NO damages, therefore WHY sue.
If your losing your house over this fall in the grocery store aisle then you had bigger issues to begin with.

Sounds like your lawyer might be in cahoots with the grocery store. Perhaps she took some money from them to make you go away? It happens.

Your lawyer can not force you to take an offer that you do not think is fair. Didn't you sign a contract with her when she took the case? If so, read it over. You many find many of your answers there.

In the meantime, find yourself a new lawyer who works on contingency and tell him your story. A store that "accidentally" copies over evidence that was to be used in a lawsuit against them is definitely in legal trouble - if you can prove that they did it.

You need to get moving or you may bypass a statute of limitations on your suit.

Good luck.

lawyers dont like to go to trial. It cost lot of money and time. Even then they dont know if they are going to win. That is why many of the lawsuite are settle out of court. Big company knows how much it cost to get the lawyers to settle the case. Best advice, try to find a lawyer that is willing to go to court if necessary.
