My sister and I lived together for about 5 months. Can my sister legally claim my 2 boys on her taxes? I already have 2 on mine and she took care of them while I worked.

No, unless she provided half of their support for the year - this means in money, not in taking care of them.

In my opinion, she can not claim the children because they are the "qualifying child of someone else". Namely: You.

Dependent splitting (especially to qualify for EIC) is an easy way to draw the ire of the IRS.

No. She can only claim your sons as dependents if she provided at least 50% of their support. Babysitting them doesn't count.

Nice try, but illegal. She didn't provide more than half of their support by definition, and they didn't live with her more than half the year. They are yours to claim. If you don;t claim them, you cannot trade them, give them away, sell them.
