Someone has been charged with over-payment of benefit going back three years and I want to know if they can do that if it is the council who made the mistake in giving that person too much benefit?

Yes they can and as its the council they can also seize vehicles if they belong to the person that owes the money.

Bailiffs however can not come into your house if you do not open the door to them!!

If there is a window open or the door is opened/unlocked they are allowed to come into your house. If you open the door to them at any point even if they do not enter your house on that occasion they are allowed to break in next time they visit.

They will take it back from current benefits unless the receiver can prove they genuinely thought it was correct.

If the receiver contacted the council and pointed out the error it was up to the receiver to keep that money back.

If it was fraudently claimed then that is a jail sentance.

Go the the Citizens Advice Bureau for help.

It sucks either way - good luck with sorting it out.

the council will turn it around and make out that this person should have known or had given false infomation. they wont take your goods no, but they will deduct or even stop your housing benefit money

they can claim the overpayment back but would need a court order in order for any goods to be seized.however probably they would put it in the hands of debt collectors who have to give you reasonable time to pay just as a court does

governments don't make the mistake of giving people to much money its the person that recieved to much money without realizing that it was to much moneys fault. nope its never the governments its always the reciever
