No, only if all five of you agree to the sale, but it would be wise to ask this of a lawyer...Or the lawyer that handled the original will...And the other child would have to agree to this as well...Then the monies would be split six ways...You could also offer to buy him or her out...

if it's 5 against 1, the 5 would need to go to court to force the 1 to agree to the sale. Can't they all work something out, like letting the 1 kid live there a while longer until he makes other arrangements? It's very sad to see siblings fighting over their parent's estate.

that is what happened to us. 6 kids. estate had to be sold and divided 6 ways. youngest son still living in parents house. he stayed until the house was sold, took his inheritance and found another home. you have to do as the will states unless all 6 are in written agreement.

My Dad is in the same situation. His sister lives in the house and the other 5 children cannot sell it until she willingly moves out. It was stated like that tho in the will. I don't know what can be done if it isn't stated in the will.
