I'm afraid the money you are sending in is a cost of living and he could well be spending it if he wasn't in prison.
He will be using it to buy tabaccoo, food, magazines, newspapers, toiletries, etc... and so a tax claim is not possible because it is all things he may well buy "on the out"
If you are running your own business and your husband was part of that business, you could say you were sending him a salary because you are still receiving his input, then you may be able to class the money you are sending him as a business expense.
If, however, you are on a low income and you visit him in prison, you can apply for APV's (Assisted Prison Visits), wherein you can claim a refund of all or part of the costs incurred in facilitating the visit, ie travel costs etc...

You are right about how inmates need help$$.
A lot of people only have concepts of what is prison life based upon tv. That's both good and bad.
Have never heard of it being claims on your taxes. Unless you claimed him as a dependent? You might want to go to the IRS's website and ask them. Also, check with your state's tax department - to see if you can deduct it from your state taxes.
Instead of filing JOINTLY with your husband, maybe file SINGLE and then you could claim you gave him a GIFT of the money?

You cannot claim this on your taxes. I tried this last year as i was sending money to a cousin who is in prison. My return was audited and so i went in to speak with auditor and was told that these types of monetary gifts are not tax deductible.

you cant, why would you think you can claim that on you taxes. Its not a charitable donation. How would that be different than if he was at home and he did not have a job and you gave him money.

If you are in the US, you cannot claim it. It is not tax deductible. It is the same as if you gave your husband $20 for gas money when he left for work. Giving it to him because he is in jail does not make it any different.

Will u be entitled to make any such deduction if he had been staying at home? Probably u r fulfiling ur obligation towards ur spouse and has not relief in taxation.
