any personal property that you leave behind is the rightful property of the owner.

You stop having any rights to the property the day you stop paying your rent. The judicial process is meant to make the landlord show that you did stop paying rent and it is okay to toss you and everything you own out of the space. The court does not say it is okay for you to stay in the home at all. Just the opposite. The court states you have no right to be there. Not as of a certain date and time, but as of when the landlord stopped getting paid.

The court says they agree you do not belong there and will stand by the landlord tossing you on the street. The only rights you had in the home were contractual. When you stopped paying the rent, you broke that contract and no longer had any rights. It's just that the landlord needs to show that to the court to be able to act on your breaking the lease. This is meant to protect innocent renters - those who did pay the rent or did not pay it for a legal reason - and not those who just didn't pay the rent.

WOW! These answers can get you into trouble, depending on the state your in. Each state has different Laws. If you're in FL, and you got a eviction that's been fully executed, meaning the sheriff came and cleared out the tenant, and gave you possession, then you must put the property on the curb. It doesn't have to stay there though, if the property's worthless, I have my maintenance guys put it on the curb, count to 10 Mississippi, then throw it in the dumpster. If it's worth anything, put it on the curb, then take it to the pawn shop!
