I think you need to check certain state laws, in most cases it is legal so far. Partly because not many have bothered to make any law on it, the other being it isn't an invasion of privacy since the face isn't seen and it's in public.

Falls under peeping tom laws or voyeurism ordinances. It is not legal anywhere I know of.
