Want to buy a preforeclosure, want to know who holds the loan on it-where do I find this info? I know previous owner (name), need to know the lender.

You may find out the person or company that is doing the foreclosure, though it might not be the bank that is holding the mortgage as most mortgage and lending companies contract this service out to professionals.

The reason for this is that most of your large lenders and mortgage companies do loans throughout the United States and most of the time it would cost to much to have on staff foreclosure specialist, because each state has different foreclosure laws.

The lender can not and will not tell you too much except they might confirm that the property is in foreclosure. They do not own the property if it is a pre-foreclosure, so they can not sign or do anything for you.

Most of the time if you check the public records the lender on record will be the lender that either owns the loan or is at least servicing the loan. That will be a good start. Most of the time that will be all you need.

The records are at the records office or at the county courthouse. A title company can also provide details.

If you are talking about a property where a Notice Of Default (NOD) has already been filed then you can get the trustee handling the action to supply you with the details if you contact them. There could be a small charge to be listed as an interested party so you get updates to the file.

Short and simple go to your county court house go to the register of deeds tell them the address of the house they will give you a book and page number you look up that information and bingo you will see who is holding the current mortgage on the house

They should have the mortgage recorded in public records as evidence of the lien. Search the local clerk of the county courts website.

Don't the pre-foreclosure listings at the courthouse say who is filing the foreclosure ?
