I don't know if this will help clarify but my company is promoting night clubs and the other company is promoting some type of music.

If that company has a trademark or copyright on their name or logo then no. However, if they don't then you can use it, but change the spelling. More likely though, they will have copyright on their name.

No. You can't use it. It is already taken if it is incorporated and they have paid the corporation commission for the name. You could end up in trouble and it might cost you so, I'd change it a little and see if it can be used that way. You need to call the state corp. commission and ask if the name is taken. If they are using it and it's not incorporated, they may not have it tied up unless they have it copyrighted? So, it gets complicated. I just gave up a name. Just Imagine...I loved it. I wanted to use Imagine but it was taken. Good luck.

You might get away with it until someone dobs you in. Then you would have to change the name anyway so why not start with a different one in the first place and save yourself all that trouble. Or you could put something else at the beginning of it or at the end of it to just change it a little.
