I work at a resturant. Everytime I try to cash my checks, there are insufficent funds! Is this legal?

Every state has a "board of labor" or a department of Labor and Industries where employee-employer issues are handled.

Oh, yes it is illegal to issue NSF checks.

It's the same with any check, illegal. You have several options (just like someone would have with you if you bounced a check).

Take a COPY of the returned check in to work and see what's up, maybe it was an honest mistake and they will cut you a new one in exchange for the old one.

or

Redeposit it (but if it bounces again, you will get another NSF charge).

or

Take it to local law enforcement or a collection agency, but you should probably only do that once you line up a new job.

It is illegal for anyone to write any type of check for which there are not sufficient funds. (personal checks, payroll checks, etc)

The reason that people don't get arrested for bouncing checks is the cops would have to prove that they did it knowingly, rather made a mistake balancing their checkbook. Next time, take it to the cashier at work and cash it from the drawer.

It's not legal to issue any checks that can't be cashed. Legal tender means exactly that. Do you know that it is even illegal to post date a check for cashing?

Go to the restaurant and tell them that they need to give you the cash for the check, and sign it over to them for cashing. Most businesses will want to do that to maintain their good name.

yes. you need to go back to your job and make them pay you in cash, plus the charges that your account incurred. if they won't do it, something's wrong, and you need to report them the the business bureau. it's illegal.

are you saying that you have never gotten paid for this job? and you were ok with that?

talk to your boss. demand to be paid in cash. if nothing else, quit. you lose money because of their inability to pay you. it's probably happening to all your other co-workers too.
