Kids should be with their parents in a perfect world... but that's not the situation we have. Kids should be with the better parent who provides stability and the emotional support they need to grow up as individuals and responsible adults.

I don't understand how "no one" has custody unless you have both simply been amicable about your separation or divorce and how she is behind on any payments if neither parent is granted domiciliary parent.(the parent with whom the children primarily reside and has the majority right on decisions regarding the children).

As for custody it seems more often than not many parents use their children for financial gain or as emotional weapons for their ex not even considering the damage or harm they are causing the kids...

Think your actions through and make sure your intentions are for the best interest of the kids and sometimes that means you will have to seek legal action. Get something ordered by the courts or mutually agreed upon by a mediator(avoiding crazy court costs and nasty battles). But work together for what is best for the kids.

As for support make sure the emtional support is there more so than the money...

And yeah the courts can do whatever they want however they want so make sure you have documentation of the children staying with you throughout the week and "visiting" her on weekends.

The truth is the truth... and the facts are the facts... keep it simple and don't overcomplicate you and the kids will be much happier.

And leave them out of it as much as you can.

Good luck and take care of them...

Yes the courts can. If you do not already have a lawyer, get one. Since you have the kids 5 out of 7 days the courts will most likely give you the kids, but you will need a lawyer. It will be difficult for a man to get custody with a lawyer, but you would have almost no hope without a lawyer.

Good luck.
