I seem to recall that the UCMJ does specifically ban homosexuality. Of course, it was written back in the 30s and 40s by homophobes and "morality" pukes, but that was the times in which they lived. Of course, they forgot that human homosexuality has been around ever since man has been around. It's not something that can be gotten rid of by human laws or morals. It simply is, and people are only now starting to realize and accept it. (Before the Roman Emperor, Justinius, homosexuality and bisexuality were very prevalent lifestyles practiced by at least half the human population.)

I BELIEVE (don't quote me on this being the end-all be-all answer!) that they still consider that if they don't ask, and the person doesn't tell or get caught engaging in homosexual activities, then they don't do much.
Basically, if a person WERE to do it, and they were in the military, DON'T tell anyone, do it at home, and if asked, tell them it's illegal for them to ask whether a person is gay or straight. Then report their question to a supervisor and let that person know that you've been singled out without cause and you feel they're trying to harm your reputation, and you're not having it.

regrettably for homosexuals...some thing that has to do with the military would not enable homosexuals......yet less than the "do not Ask, do not tell" coverage you may connect any military software contained in the united states yet you won't be able to say that your gay or act gay. so no gay habit is permitted.

I'm not sure if this is totally related to the question, but the "Don't ask, don't tell" policy does seem to ban it.
Just because I answered this question as it is doesn't mean I have anything against gays.

YUP... not only that.. but UCMJ also bans yer wife or hubby committing adultry.. (you can be discharged if they do.. yer responsible for your family as well)
