This is all very nice, and the simple answer to your question, which makes absolutely everybody "feel good about themselves" (I hate that phrase) is NO.
The problem is that nobody seems to be able to agree on exactly what torture is.
My cat, I'm sure, would consider it to be torture when I give him dry food instead of fresh fish. But the dry food might be better for him. The level of pain my wife would consider to be torture I, who have played contact sports all of my life, would not pay much attention to.
So, unless and until we can agree on what torture comprises --- at the margin, since we can all agree on the extremes --- I would suggest we act and talk a lot more carefully than we seem to be doing.
The simpler you state the question, the more complicated the answer you are likely to get. But, since we are dealing with a serious question I would suggest that before we debate it, we agree on what we are debating!
So, in my view, your question has an answer, but in the way you have expressed it, it has no answer.
