yeah. i think she should, cos it was given as a gift to celebrate what they are doing but if she calls it off then she no longer deserves it.

Yes, The engagement ring is the tangible form of a contract to marry. In breaking that contract, she forfeits the ring, and since you weren't married, she has no claim to any property.

Now a wedding ring is hers because she has fulfilled the requirements to warrant it, and custody will split anyway, so I guess it would only be a point of contention if the divorce was really bad or the ring was really expensive.

Even if you get the ring back, you should sell it. I can't think of too many women that would appreciate a hand me down ring that's not an hierloom unless it's like 3 carats.

Yes, engagement is considered a legal commitment. If that commitment is broken, the ring should be given back. In fact, an engagement ring is THE ONLY gift that ever needs to be returned when a relationship does not work out.

Yes, in most states, if the bride to be ends the engagement, she is LEGALLY obligated to return the ring.

And in some states, even if the MAN ends the engagment, she still has to return it.

In NO cases does the bride ethically keep the ring when she broke it off, and if she does keep the ring, she is quite the slime

The man does have legal recourse though, and unless the woman is somehow out financially due to something the man did like embezzling, he will always win.

Legally, the guy is entitled to get the ring back as it is a symbol of a verbal, though legal contract to marry. Once you break that agreement i.e. the engagement, there is no longer a contract and he can get the ring through the courts if he wants to persue it. Save yourself that hassle by just handing it back to him because though he may not want it back now, he may want it in the future when his feelings for you change from love to resentment(which they will eventually) and he would still be entitled to get it back.

Not to be mean but I have to say yeah she has to. If she ended it what does she need it for? A remembrance that she ended it and she got the better of it because she's got the ring? Is she planning on selling it to make a little bit of cash because she reckons there should be a price to pay for being with you?

Hope you get your ring back buddy. If not a small claims court might work.

Difficult one this one. Most guys wouldn't want to have an engagement ring back - other than to sell it on. Most women also wouldn't want to keep the engagement ring if they split.

I think, traditionally speaking, that the ring should be given back. On the other hand she is under no obligation to do so as it is hers.
After i was divorced i sold mine on Ebay!! My husband would have done the same anyway.
However, i was engaged before this when i was young and did return the ring.
I think it is up to the individual and what they think is right/best.

I have given the engagement ring back to him. It must be the most painful thing ever but in the long run, it's for the best. I guess it's better than divorce.

It depends on who broke off the engagement but if you really want to get over him completely then it might be a good idea to return his ring or giving it to a homeless person.

Judge Judy always makes the girl give it back. She accepted the ring with a promise to marry the guy. If she's breaking that promise, she needs to return the ring.
