Do you not have a clause in your contract that forbids him from doing this? I forget what it's called exactly, but it means that if you leave the company, you cannot work for a competitor for the next year (or maybe it's 18 months). I am not sure where he stands legally if you do not have this clause, but to be honest I thought it was pretty standard.

My company have it. They do not seek to enforce it if someone has been made redundant, but if someone leaves of their own choosing then they do. One woman in one of our overseas office not only set herself up in competition, but took five years' worth of files and contacts with her.

But in answer to your question, yes, I would advise head office if I were you. Tell them that you do not wish him or anyone else to find out that it was you that told him, and I'm sure they will respect that. You don't want your colleagues to think that you're a grass and can't be trusted, but at the same time, I truly believe that this is the right thing to do. It's what I'd do.

It depends. While he should be applauded for going out on his own, he may be in violation of his employment contract with your firm IF he signed a non-compete agreement. If he is in violation of such an agreement, and you REALLY believe that he is a threat to your office, you need to either go to work for him, or inform your head office. Be prepared, because they will sue him. Tough decision. Good luck.

Come on now - You're probably jealous that you didn't think of it.

Wish her/him well.
