how would he go about removing his name from the child's birth certificate the mother wanted him to terminated his rights , so why should she have the right to allow his name on the birth certificate?

Send a copy of the order terminating parental rights to the state office of vital statistics.
That order should have a section pertaining to the childs last name.

it depends if you are removing his name as father from her birth certificate there must be a reason it opens the door to other things of course as every move one makes in life does he could request a DNA test for paternity and while the courts normally do not bother with this having him removed as father does raise some questions. if a paternity test proves he is not the father you have no claim against him for child support and if he has half a clue he will sue for any support payments he provided in the past and probably win. how much money is that you might have to pay back? if he is not the father you have good reason to remove his name and he probably should not have been there in the first place if he is the Father there really is no good reason to remove his name from the record that is just being petty particularly if he does pay child support and / or has any kind of relationship with the child long term it is best for the child to have some connection with both parents regardless of how they feel about it if you were to croak in the next few years the birth records give your child a place to start should she ever decide to look up her father for whatever reason Medical History regarding certain hereditary conditions that may deveklop over time is one very good reason to keep his name ther if he is the father.

most states have what is called a "BASTARD LAW", removing yourself from a birth certificate is not allowed.
having your parental rights terminated, is a whole different issue. he is and always will be the biological father.
this is not about the ex, but the children.

Talk to vital statistics and your local probate court BUT, unless the mother wants his name removed or even the children.....it may not fly.
