I recently broke my leg and now im cruisin around in a motorized wheelchair and I was wondering if drinking and driving it was a bad idea.

yes you can i did get stopped for being drunk in public while driving home on my powered wheelchair i dont know about youre state laws in youre state but in arizona the cop just gave me a warning i think he was just checkin to see if i was ok because i was toasted drunk plastered and everything else in between but yea it is possible and my friends were stopped when they where wheeling in there custom made manual wheelchair so be carefull cause they could fine you or arrest you

Well, it certainly would be a bad idea, but that does not necessarily mean it would be a crime. As has been correctly stated, without knowing the state you are in, it is impossible to answer the question. In California it would not be, because a motorized wheelchair used by the disabled is not a motor vehicle under CA law. (Veh. Code section 415, subd. (b).)

They could arrest you for public intoxication. Out where I live in a rural area, people like to ride horses and drink . Sounds dangerous doesn't it?
Those guys say the only thing the cops can get you for on a horse is public intoxication, I'm guessing the same goes for a wheelchair.

For safe practices causes, i imagine it will be mandatory that each and every one motorized wheel chairs have reflecting tape, and a white pole with pink flag. How is motive force of a motor vehicle or a truck meant to work out this man or woman in a wheel chair with low visibility subject matters? surprisingly as nightfall or first light. that's merely way too risky.

For a gov't to descriminate against a handicapped (even temporarily) individual, it would be illegal.

If a walking drunk person is charged with "public intoxication" then so should a wheelchair (motorized or not) bound person.

If charged with DUI for such activity, you're going to get a walk as long as you a lawyer half as smart as me.

It depends on how your jurisdiction defines a "motor vehicle". I am indeed aware of places it could happen. After all, I've seen DUI's for people on lawn mowers...

Yes you can. A person can even get a DWI on a horse, a bicycle, a golf cart, a segeway - any motorized vehicle.

Yes if you are in public.

You can get a DUI on a bike if you are on a public road.

Just like public intoxication, you just have to be out there.

Be safe if you are going to drink, do it at home and stay home.

yes and no...yes bcuz if ur "driving" and ur on a road where people drive and ur drunk, then yes... no bcuz ur parilazed..but if u do drink and drive, have someone take the batteries outta ur wheelchair so someone can push u so u dont go into some traffic and get hit.
