My partner has been seperated from his wife for 3 years,she wont divorce him,he has currently been removed to Afghanistan,which means it's hard for him to divorce her.Can he divorce her without consent or will he have to wait into they have been seperated for 5 years.

the laws differ in each state..so i would do a google search for free atty. advice....there are a few out there....
or put in the state where he lived+divorce law...google should give you something.

There is no law in this country that will obligate anyone to remain married! There are many ways for him to get a divorce, with or without her approval. There are many associations that will give him free advice on what to do. The divorce will be a little tougher if there are children involved or if there is property or any other asset to divide. The fact that he has been deployed has nothing to do with the fact that he wants a divorce. There is no such thing as a 5 year waiting period!

If they have NO children-yes. If they do have children-NO. When children are involved it's much more involved. A parenting plan needs to be done, etc. Is their anyway she can get his signature? Is that a law, that after 5 years of separation they can divorce? Never heard of such a thing!!

go down the local court and get the papes get him to fill them in and take it back to the cout sweety it cost around 300 but its the quickest way he could be div in 8 weeks good luck x

one year separation is good and yes can be done without her signature just will cost more especially since they're in separate countries
