I am worried about the background check since this job will require me to have a company car. I was told by my lawyer since I was not convicted, this will not be an issue seeking further employement. I am a little worried. Please help with any advice.

I'm pretty sure that it will. When you get a company car they will run your licsence and then see that you had a DUI and that will cost them more in insurance. You will not be considered a safe driver for them. How were you "not Convicted" if you plead guilty and had fines, class, and probabtion?

You can't visit because he is a minor and usually only parents can visit. They are strict and mean because it is a jail and that is the way it works. If he doesn't like it, he should avoid going back. That is the point. Its not the Hilton.Most jails have strict visiting hours/days when only certain people can visit. Often visitors must be pre cleared or put on a list prior. You usually can't just show up. In addition, he may have been sent to detox or is still in the intake stage. Then again, he may just not want to see you. As far as pleas, they arraign you and ask, How do you plead? Happens thousands of times a day all over the country. ever hear of innocent until proven guilty? At that point he can say guilty or not guilty. Even if he tries to say guilty, the judge will often discourage that until he can talk to the DA and his lawyer. People rarely plead to the crime for which they are charged, even if they are as guilty as can be. They usually accept a plea. If this is his first offense, he most likely won't get jail time. The DUI will most likely be plead down to a lesser offense, as will the other charges. He will pay some serious fines, probably be on probation, have to do some sort of drug/alcohol treatment and lose his license until he is 21.

your lawyer's an ***. if you plead guilty, then you've been convicted. unless you've had your record expunged, and you would know if you had, then its on your record and it will show up on the background check. it remains up to your employer to decide how big a deal it is. i would cop to it before the employer found out and tell them why it was an out of the ordinary thing for you and a mortifying experience that you are very careful to NEVER repeat.

p.s. a DUI will show up on both a driving record and a criminal record, as it is a violation of both

Absolutely it will affect your chances. You must report it for the rest of your life. Unless you go through a diversion program that keeps it from appearing on your record... Some states/counties have pre-trial diversion programs that allow you to complete community service; jail time; and alcohol classes and it will not go to trial. If this is a pretrial diversion it will never show up. If you go to trial and you plead guilty, then you have been convicted and it will go on your permanent record.../

you should fire your lawyer, first DUI is a FELONY and when they ask you have you ever been convicted of a felony you must answer yes, why? pleading guilty is an admittance of guilt. pay your fines do your probation and get your record expunged. oh and just in case, if you refused a DUI check your autmatically guilty!!!!

You plead guilty therefore you were convicted. It will definately lessen your chances of getting a driving job.

All you can do is apply and face the music.

I'm sure that your attorney wouldn't mislead you for any reason.

Call them and just ask what they think, your past DUI attorney.

Never, never, ever drink and drive.

Only if they check your driving record. It shouldn't show up on a criminal back ground check.
