is burglay punishable by death? What's the right answer there?

you may respond with deadly force only to protect life, not property.
in your home, you are permitted to assume that an intruder is dangerous enough to kill you, and you may kill him.

however, if the circumstances make it obvious that they are only after property and would not hurt you or your family, then you are not permitted to kill him just because he's in your house.

its pretty safe to say that it is okay to kill an intruder (though not in the back, if he's not facing you, he's obviously not gonna hurt you), because he could kill you. BUT it is NOT a blanket rule; very few rules are.

p.s. if in attempting to kill your intruder you suceed in disabling him so he is no longer a danger...he breaks his leg when he falls down the stairs after he sees you pointing a gun at him. at this point he can't go anywhere and can't hurt you. thus you are not now permitted to go up and kill him just because he's an intruder. you must call the police and let them handle it. i repeat, you may kill only to protect your life.

Break in to my home, I catch you, BANG! You are dead ... no warning ... no chance.

In some jurisdictions the use of deadly force to protect property is legal (encouraged (unofficially) in some areas!).

In the rest? Get real! the perp is DEAD (nobody is gonna get a statement from him!) I confronted him, he reached behind his back (at the waist line, going for a gun?) I shot the SOB! Justifiable homicide at it's best!

When a citizen is in "reasonable fear for his life and limb" he may respond with deadly force. Perp enters your home without permission (Crime #1), obviously this person doesn't plan anything good for you! Perp, when confronted, makes a movement ... going for a gun? going for ID? just freaking out? You have about 1 second to decide! Guess ID or freaking out and be wrong just once ... GAME OVER! NO reset button available! YOU ARE DEAD!!!!

Get the drop on your aggressor first! Perp goes under his coat, behind his back with his hand ... expect the WORST! He is going for a weapon! Drop that sucker NOW!

It is true, better to be judged by 12 than carried by 6! Those 12 might put themselves in you shoes, and find you not guilty! Once you are in the body bag ... no escape!

In advance of the bulls***! The cops will identify themselves as such. If 5-0 is executing a warrant, you will be able to tell them from "Jimmy the dopehead" looking for a quick score! Don't shoot the cops (OK, your reaction time drops by 1 minute to identify the inbounds), DO shoot "Jimmy the dopehead!"

    Yes   you   may   shoot   the   intruder /   intruders     if    they   pose   an    immediate    lethal   threat    almost   all   burglaries occur between the hours of 11pm to 6 am. And if some one breaks into your house in the middle of the night then obviously they have the intent of harming you and your family. You then would have the duty if this occurred to protect your family at all costs meaning shooting the intruder dead and asking questions later. No you will not go to jail for justifiably using lethal force to end a threat the cops might have some questions but that would be all.

I would not hesitate to shoot someone breaking into my house. And no, burglary is not punishable by death, but if someone is breaking into your house, with you there, there is a great possibility that they will kill you. Someone who is just there to burglarize your home knows if you are in the house or not, most of the time. And if they didn't I am not going to try and find out. They are in MY home trying to steal something that I have worked very hard for and they are there uninvited... so, I think that when they break into your house, they assume the risk of being killed. I have children that are my main focus.... YES they will die!!!

If I'm home when they break in, how will I know they are just wanting to burgle? If I'm not home when they break in but I come home and I can see they are burgling, and I can get out before they shoot me, then I guess I won't shoot.

Anyone breaking and entering runs the risk of getting shot. I would shoot to kill, since my life and property are at risk and I am unsure if they are armed or not, but a reasonable person would suspect that a burgler would come armed.


I am quiet sure that my getting to shoot an intruder is mostly a rich fantasy life. Since I already have loudly barking dogs on watch.

I would hold him at gunpoint, and if he makes a move like he was reaching for a weapon, I most definitely would shoot him. If he bolts and runs, I would just let him go, because deadly force is no longer justifiable.I would not pursue him, because I would become the agressor then.

look at him, if he appears to be armed, do not hesitate. if u ask him who he is, and he doesnt answer or charges after you, do not hesitate.

in my neighbouring country, if they are prepared to rob you, there is a high chance they are also prepared to hurt you. its a brutal city, there are some cases of tourists getting killed too.

a friends used to advise me, since i usually need to go there to send my relative for traditional healing:
arm yourself. if they are prepared to hurt you, or might even kill you, you have every right to paralyze or kill them.

which is very true. last year, there were many cases of my countrymen, being robbed there. many were wounded in one way or another. there were a one who was killed and tossed into a river! such cruelty... i'll never forgive the robber...

but personally, i would not dare to kill. if it was me, and he really is a robber, i would shoot to paralyze him. until i am sure that he cannot harm me, contact the police, etc2...

YES- just try not to shoot him in the back, that's a bit of a legal hassle.

One has the right to protect themselves with lethal force if attacked, especially in the home.

PS- It is good for society too because it stops a looser criminal from costing the public more money in legal defense, housing (jail/prison) and other folks' a lot of trouble.

I depends on what state I was in. Some places you can shoot them and its ok. In others your not. I guess I'd have to call a lawyer first

I would shoot someone if they broke into my house. You don't know what their intentions are, if they are armed, if you are lucky enough to scare them off will they come back at another time, etc. You must defend yourself and if I feel threatened in that way, I certainly would.
