I had my son in May and the father wasn't there to sign the birthcertificate. I gave him my last name too. Now that my baby daddy is in a better state of mind, he wants to be added onto the birthcertificate as the father and give my baby his last name, which I have no objection to. Adding him onto the BC as the father is a simple process. It's the changing my baby's last name to his dads last name that is the challenging things, for me anyways. I just know I have to petition the court to change his name. Can anyone enlighten me on what to expect or tips on how to go about it? Also, I don't know if this will matter, but considering its a process done in court, my baby daddy is not a legal citized...will that present any problems? I would really appreciate the advice...Thank You!

im not trying to send him back to mexico.....thats why i havent gone straight to the court and handled it already because like i said, i wanna know what to expect...

man as i read on and on in the answers I dont even know why i even mentioned he was illegal. but like someoe said...now he can become a resident and hey if i married him a UNITED STATES CITIZEN. point is, I would still have to change my son's last name....which hey come to think of it, wasn't thatmy ORIGINAL question?

Secondly, for those of you hung up on the fact that the father is not a citizen - now that he has an American child, he will be able to apply for legal residency, and then when the child is 18, for citizenship.

As for answering the original question - once his father's name is on the birth certificate, you'll be able to use that as his ID for the rest of his life, like school & such.

I think the only other place where you will have to make the change legally is with the social security administration. Try calling them to ask them what you should do once you've changed the baby's birth certificate.

since he is not a legal citizen, it might be harder, and when they find that out, he probably wont be around much longer. But the process is diffferent in each state, just contact the welfare office, they usually know how to do it, or at least give you a place to start.
