My 2 kids & myself arived here last June 20, 2007, after 3 months of unstable relationship, i found out she's having relationship & that started my decision to stay away from her. Now she is going after me for child support, i know very well about that law but i dont want to give my wife any cash but rather i can give my kids what ever they want in goods. She has created great destruction on my peace of mind. I got contractual job in the construction industry & i want to move on to stabilize myself for my future & my kids. Can i use what she signed in her contract of sponsorship (3-10years of support) for legal counter purposes? I want to get my kids back but how? My kids are 10&8 y/o & need to be treated well. Im earning $18/hr. Considering my apt. rent of $550 & $506 car loan, would it be enough to support my kids and save some for future loans on housing? Im totally confused and i need legal advice. First, to clarify: Your wife is a permanent resident or citizen of Canada. She sponsored you to become a permanent resident of Canada, and her application to sponsor was approved. According to the Sponsorship Agreement, your wife is required to support you for three years and your children for 3-10 years (depending on their age). A court will enforce this agreement, but you will need to initiate legal action.

If your wife seeks a child support order from the court, you need to pay it. Provincial and Federal Laws determine guidelines for the amount decided upon by the court. This will be enforced by the court. However, the courts are sensitive to whether this will create undue hardship when they determine the amount of support.

It may be that your wife's agreement to support the children for the next 3-10 years will be a factor. To answer this, it is important that you consult a lawyer who is experienced in immigration law and family law matters. The lawyer can represent your interests in court and advice you on how to proceed. You may qualify for Legal Aid. If not, there are community Legal Clinics which may assist you.

First of all I'm assuming you mean June 20, 2006 instead of 2007 becuase that haven't happen yet, and you are right about the contract that she signed but do you really want her to tell your kids that when she ask for child support you won't help her. Children not only need goods, they need much more than that i.e, education, love and support from both parents and etc. I can see that you love your kids and the only way to get custody, partial or full, is consult a family lawyer.

In most cases you don't have any say on what your children get. They take into consideration that the child support goes on the kids and most people think that it's for the kids only, but you have to think the house payment, lights, water, gas, food and all the other household bills are for the kids as well. If that stuff wasn't paid then your kids wouldn't have a place to live. Also in some cases you can ask for receipts on what she used your money for. I knew someone that did that when his child was a baby. She had to show receipts of the food, diapers and all that stuff that she bought for the baby so she could prove it was used on the baby. It all depends on the state law. So many states are different. But good luck and get an attorney!

You're not making any sense. You said you just arrived in Canada with your kids. if your kids are 10 & 8 ore they you're sponsers(wife) or ex wife. Do you have kids with you're sponser(wife). If they are you're children And not you're Sponser's childeren then she can't keep them unless she went through court to adopt them, marriage doesn't give her te right to takr your children. If the mother of the chidren is taking you for child support, and she has leal custody of them then she can. You can always go for visitation or custody through courts. I Don't think the sponsership papers will help because you make too much. If you had no money she would be financially responsible until you were allowed to go on welfare.
Since you are working and are single again could you still work if you had your children, being as you not from canada and have no family support.

You need an attorney.

Unfortunately, you don't get to choose how you support your children.

Children require cash, lots of cash, and it became your responsibility to see they have enough the second they were conceived.

What your wife did to you or does with her life is irrelevant.

Talk to a lawyer, an expensive one, today or you will really get
screwed. Cheap lawyers are usually just your first attorneys, the ones you learned your lesson from before laying out the cash for the one who will represent your best interests and fight for them.

i don't know anything about canda but here they let you pay child support threw a court or garnish your wages talk to a lawyer in canada they would know
