I have heard that a win will help you get your money by docking the loosing parties payroll checks ( in California small claims courts) .

if you win the judgment, and if you know where the other party works. you may have the court Issue a Writ of Execution. (there is a $15 fee to the court) this is the document... http://www.courtinfo.ca.gov/forms/documents/ej130.pdf . the writ enables you to have the other parties wages garnished. after having the writ issued by the court you must take it the sherriff to have it enforced.

Hi
I live in New York State, my friend sued in Small claims court, and was told, that although he won, getting the money would be another story. The judge can order someone to pay you, just not make them do it.
But the satisfaction of being able to state the facts, and have a judge agree with you, might just be enough. TO know that someone else,a agrees you were wronged, and to have your day in court to face that person , might just be priceless.

You go!

You still will have a heck of a time ever getting your money from the loser, even if you win, but it could be worth it anyway, if nothing else then to make the loser suffer a little.
