You CANNOT file with him. You are single or head of household now, but not married.

I believe you file based on your status as of 12/31/2006. The only exception might be if he died in 2006, where you may still be able to file as married.

You are divorced. The settlement dictates the tax filing.

Have you talked to him about filing with him? Personally after my divorce was final, I did my own thing.

File WITH him. That way if he itemizes you won't end up PAYING. I learned that lesson when I filed for myself and my ex itemized...I paid more than $1,000.00 that year and I made only $1,500.00 that year!
