I filed 2 years ago. My soon-to-be- Ex has made this an arduous process. He has defied court orders and resisted settling fairly. He has hidden money, and tried to devaluate every asset. His wages had to be garnished, as he wouldnt pay the spousal support . He closed our savings account and the part tme business account and put them only in his name about 3 years before I filed. I have been unable to pay my lawyer very much and the interest has built up .His lawyer has canceled meetings to settle (they have attended the Court ordered ones tho ) and often says he hasnt received paperwork and documents from my lawyer. He lied his way thru the deposition. A friend told me that the Judge will probably tell us to go downstairs to the courthouse cafeteria and hash this out. Do you have any experience or answers?

I would suspect your attorney isn't doing his best on this. He should have registered mail receipts showing that the other lawyer has received papers. Also if your husband has defied court orders before it should help to build your case. If you feel your attorney is not doing everything he can for you because your are behind in payments maybe you should seek counsel of another attorney. Some attorneys will work on contingency which is rare in divorce cases, but if he knows you can receive money he can attach it to pay his fees or work out a pay schedule with you. You also might try calling the state board that governs attorneys - if you can't find that number just call any attorneys office and ask for it. I have been where you are and it isn't pleasant. Just keep asking questions and don't feel you have to just accept the fact that you loose. Maybe a woman atty. would work harder for you? I wish you the best.

It's all a game of politics. The answer the person gave about the system is set to screw him is partially right, but to me is also chauvinistic. It's sad that people categorize men as always the one at fault. There are a lot of good Dads out there I myself am a Dad and have custody of one of my boys. I don't know your whole situation, but do have experience being devorced with kids. I hate to say it but a lot of times it has to do with who has more money and who the judge is. I can't blame your soon to be ex for trying to cover all of his basis. But if he is bein an *** about it there is no since in that. If it is a good judge they will look at what is best for the kids if there is any. As far as him closing the accounts and hiding money you need to have proof of this, how much it was, when and were it happened. Keep a book and document everything that has happened and does happen on a daily basis. He will have to pay the support one way or another. File on him everychance you get, for failier to abide by court order. It will come back on him eventually. Go into court and be yourself, be honest and truthfull about everything. The judge will see that you have tried to settle out of court and will take that into concideration.

If any of the money or buissness was aquried before the marriage it will more than likley go to that person who had prior control. If it was after the marriage then it is 50/50. He can not legally by law sell or get rid of anything after the divorce has been filled if he has then he is is violation of the order. In your papers it will tell you that nothing can be sold or gottin rid of after the papers have been filed. It will say it in legal terms but you understand. I hope that I am not lying to you I know these rules apply in Texas and several other states. You might want to look into it and keep a detailed record of everything. I hope this helps. I had a friend who got divorced and it had to go to trial as his ex wife refused to settle. The judge gave her less than he was offering in the settlement offer.
