My husband and I have had guardianship of our grandson since he was a month old. He's now 11. My husband is retiring this month and is already collecting Social Security. Even though neither of us are disabled, can I collect Social Security on my grandson? If it helps any, we live in California.

The answer is yes. You can collect. However, in the state of California, you have to have legal custody of the child. Guardianship isn't good enough for SS. They will refocus you to adopt the child. The childs parents do not have to be dead or disabled and neither does the child have to be disabled. If your husband is collecting SS already, so you could collect as a dependent, IF you adopt!

As long as you have legal guardianship, you are entitled to benefits for your grandson. My in-laws were given guardianship from me when my husband and I split up. He was on SSD and so we made the guardianship legal and they got the benefits. Later on my father in law was put on SSD and now the kids draw a check off of him. You should also get a back pay check from the time your husband started getting his benefits.

You can if the parents are both dead... that is a death benefit from the government and you should have been collecting it since you acquired guardianship. Otherwise I do not believe that you can collect ss... you don't have a viable claim.

My husband and I have legal custody of my grandson and he has ADHD and is on medication for it. Can we possibably get Social Security for him? We live in Michigan.

have a toll free number, in your telephone directory.

Not unless your grandchild is disabled.
if you are looking for financial assistance for your grandchild, see an attorney and sue the parents for child support.

I'm pretty sure that you can but you have to call your loscal ss office for the requirements.
