In the USA, your parental rights are suspended to a point however the incarcerated parent may still be able to designate a grandparent/aunt/uncle as the guardian if contact is made immediately with an attorney to handle the situation. Unfortunately, the child may spend a few days in a temporary foster/group home until the paperwork can get processed.

The laws vary from state to state and country to country. An attorney is the best person to consult on this and you may even be able to get a free consultation.

I would think none since they are incarcerated. All of your rights are given up.
