Fencd/cement wall is along our property line and only 4 ft high. Gate is to go on our side of property line. Homeowners insurance says our liability is great if someone falls/slips off the wall into our property. Backwash from pool will drain onto our yard since we land is sloped. We have a pool also (backyard) and we know what damage to lawn is involved. How do we mow wet grass?

I highly doubt the neighbor is going to be able to get an approval for the pool even though his buddy is on the board. His buddy isn't going to get the zoning law changed just for him that's for sure. There are lots of rules that need to be followed when doing something permanent. You have to be so far from lot lines, and with a pool you have to have fencing around it and the fence has to be so far from the lot line, main road and so on. Not only that, but this would open the doors for the whole community to jump in and fight against it or decide that they all want their swimming pools out front. Could you imagine?? Yeah...... highly unlikely! Thank God for small favors! LOL

by skill of sending out an email to the community, you're inviting young babies to come again on your pool. If I have been you, i does no longer deliver out the e-mail on account which you're putting your self up as a public pool club. in case you experience obligated to deliver the e-mail besides, i could shrink the pool to "first come first serve" as much as 4 at a time (all those below 18 could desire to have a verify present day) and incorporate particular hours and particular days whilst the pool is "open". If the youngsters abuse the privilege the different time, they are going to be uninvited to apply YOUR pool. bear in mind, you're in charge for the youngsters on a similar time as they're on your sources.

Having a buddy on the zoning board doesn't mean he can break the law, if it is in fact a violation. Who would want a pool in their front yard, anyway?

First, they have to have a hearing on a zoning exception, so you can try and block it there. If that does not work, have a lawyer file for an injunction against him creating an attractive nuisance. That should tie him up for a while.

I don't think you have anything to worry about...it will never happen.
Nobody in their right mind would give a permit to that. I think this neighbour is really trying to stir things up with you.
