I have asked the father of my son ( we aren't married) to leave my house as he got us evicted at our last place and hasn't paid the rent again this month. He also stays out late, drinking. He is now homeless and due to his bad credit has trouble finding a place. His car is about to be repossessed. What are my chances of getting full custody of my 10 months old son ?

First you will need to go to family services in your area and file. It's that simple. You will need to have proof of why his father does not deserve at least joint custody. Good luck

Since you two are not married you already have custody of your son.

Have you two gone to court in the first place to establish custody.?

Is he on the babys birth certificate. ? If he is not then I would leave him off for a while. Unless he trys to get custody of your son then he will have to be the one that takes you to court and then you can show that you are the one that is the proper parent.

And not to be mean but have you not paid the rent.? Since He did not pay it in the last place you two lived in and had to move, you would assume he might not pay it in the place you are in now.

You really need an attorny or legal advisor to tell you this. You have a very good chance of getting and gaining full custody of your son as long as you are a responsible mom and caregiver.

I would start with giving him a police escort off your property, out
of your apartment etc. Then get a police report to take to court
for the Judge to see. Explain your circumstances and let this
"boyfriend" pay rent in the local jail.

excellent, especially if you are taking care of your son. Document all the time that you are with your child and go and see a lawyer.

I'd say pretty good.....but you should get a lawyer and make sure that happens...otherwise your son could be in jeopardy....don't let that happen and good luck to you....
