I was divorced from my childrens father in Michigan in 1999, at the time I was moving to Alabama and thought it in the best intrest not to uproot the children from everything familiar. I moved back up north about a 2 hour drive from where they were living about a year later. He calledtold me the kids wated to live with me and he would allow it but he wouldn't sign over custody. We went on like this for some time until one day he decided to keep my son. I told him I'd fight for custody or we could come to an agreement. The agreement we decidedon is I would get custody of our daughter and he would keep custody of our son. We moved back to our home town shortly after this to be close to Aaron (my son) which would allow for easy visitation. Shortly after thishe move to Illinois. About 6 months after his he called me and said Aaron wanted to live with me and he would sign over custody if I would agree to sign paperwork saying he would'nt have to pay child support.

How old is Aaron. He may be old enough that a judge may take his wish to live with you into consideration. Then, your ex would not have any reason to try to get out of paying you child support.

Well I think that in any case the absent parent should have to pay for the child it does take two to make them after all. However depending on the relationship between the two of you, like the back and forth of the kids as to who they want to live with and when it might be the best thing. Something else that could be done is joint custody for the both of you but the kids live with you full time and he just get visitation and has to pay. Talk to a lawyer that does free consultations.

just get a good lawyer. and in any custody case, the court will usually hear what the child wants (if he's older, then the more weight/value his wants are given).

dont sign anything until you talk to a lawyer. or work with the lawyer you had for your divorce.

So, basically, he just didn't want to have to support his kids. what a deadbeat! Take him to court for custody, and child support.
