I live in an apt building and have a idiot above me for a neighbor. Loud noises all times of night, heavy stomping etc, running through the apt and such after midnite, etc...My question is, I am moving due to his actions as well as some of his friends he has over. Can he be sued for moving expenses and/or the increase in rent I will be paying? There is also harrasement on his and his friend part which is on tape. The location is Maryland. Thanks

Thanks all for answering...Yes I do have a paper trail...as well as police involvement. The tape that he and his friend can be heard on harrassing me is actually a 911 call to ask for the cops to come out and speak to him yet again. So yes, I have spoken to management numerous times and according to them he was sent letters. The call when he is on tape was made after the dates of the letters that management informed me was sent out. Also, he has had cop go up and talk to him and ask him to pipe down the banging and hammering on the walls at 2 am. Management has given me the ok to move but I just wanted advice on if I could sue him for moving expenses and possibly the increase in my rent. Again, thank you all!!!!!!!!

well, did you lodge formal complaints and nothing has been done about it..both to the landlord and the police. because then , yes you might be able to. however, if you are just moving instead of saying something to the "chain of command" then you are the one who is responsible for your moving costs.....

YOu can sue a ham sandwich if you want to.
The problem is PROVING that you were 'forced' to move because of them...
Is your lease ending or are you breaking your lease to move?
do you have any complaints on file with your landlord about this guy and his behavior and that of his guests?
what about police reports regarding them and this harrassement stuff that you have on tape?

I guess you are seeing where I am going with this line of questioning. I am asking you, DO YOU have any proof of the claims you are thinking about making in court?
If not, dont go thru the expense of suing them as your arguement will be ripped to shreads by any first year law student. *(talking about adding insult to your injuries)

Consider the extra money that you are going to have to pay for you new place..after you move, you will see that it is small price to pay for your piece of mind that you will regain in your new place.
(also keep your recipts as in some cases you can deduct your moving expenses on your taxes if you itemize)
IT sucks that YOU have to move when clearly you have done nothing wrong but I commend you for removing yourself from what could potentially have been a very hostile situation where someone could have been hurt or killed.
IT does not sound like it would be worth the hassle to file a civil case against bigfoot and his neanderthal friends...but I would file a police report regarding the harrassment that you have on tape. The state prosecutor might just send him a little love letter informing him of a criminal court date where you can request a no contact order (or whatever they are called in your state).

did you take the necessary steps to warrant a move?

did you complain to him directly? if so, did hte noise continue?

did you complain to your landlord/resident manager? Did they talk with the neighbor? what resulted after that?

did you make a formal written complaint to both him and the landlord/resident manager that your requests have been ignored/

did you file police reports for the noise?

if you didn't any of the above, then you will have no case, even if you recorded it. Because you have not "trail" of complaints, they can say, "Well, you didn't complain!"

i do not believe so. and i would suggest that you look over you rlease agreement. i had a situation like this that prevented me from being able to sleep.

after discussing the problem with my landlord we came to the conclusion that he was responsible fro providing me with a Habitable living space. and with all of the yelling and stomping it was not habitible because i could not sleep. (well i slept durring the day but it was a principal thing) he agreed to evict them for causing noise violations. and agreed to give me free rent untill the eviction went through, it took him 6 months to evict them. and i got 6 months of free rent added to the end of my lease.

but this was due to a clause in my lease agreement, i would check with a lawywe about your tennent rights. usually you have the right to a clean and habitable living space. that is free of extensive noise/ aggrivation. and bugs...yes you can make them spray for roaches and such.

Anyone can sue anyone for about anything. Collecting is another thing. If he is already harrassing you I would think you would want a clean break. Go ahead and sue him and provide the address that you are moving to. Think about it. Just move out and move on without that idiot.

If you did complain to your landlord and police dept get all of the statements to who you filed the complainted with before you go to court..
