I was in France and it was nice to just be able to walk to be, I think it outwieghed the small benifits these laws have for small amount of people. It seems like one of those laws that are worst case scenerio ruins a big part of life for everyone.
Talk about freedom....
thinking alot about this lately...

Yeah, I agree, I (In America) usually take the storm drain underground tunnels to go to my friends house, well one day I was just walking underground with a flashlight, I came up and walked down the street and a police car pulled me over and fined me for 250$. It is a very dumb law.

Generally speaking, that's the only time loitering and trespassing are enforced. I have over 40 acres of land, have no trespassing all over, but kids play on my land all the time and I don't care. It's there to keep out the hunters, etc. The stores that have No Loitering posted generally only enforce it when they feel that they or their customers are being threatened by people doing so.

No that is a bad idea, people have rights here the right to privacy, the right to private property ownership, that just opens the door to a whole host of criminal problems...and like the government would ever do away with trespassing laws then every body and there mom could just walk into area 51right...

well as some one that went to school in France, trust me you must have been in the more touristy areas, cos they have VERY strict laws about loitering but that said they have benches and seats all over the place for people to just sit and watch the world go by, which I have done in many places here in the USA and never been approached or moved on.............could it just be the areas you are trying to "sit" in that causes the initial problem?

Freedom does not mean free to do as you please. The laws are in place to serve a purpose. Its not the cops jobs to determine someones intentions on a case by case basis. I agree, sometimes it seems like the laws are stifling, but to live in a civilized society, we have to respect the laws, even if we dont agree with them. Just think if there were no loitering laws. People could hang out where they pleased, interfering with businesses & peoples homes & privacy. It would get ugly.

I don't have much of an issue with people loitering. If they are on public property, there is really no problem. Now once you're on private property, without permission, you're trespassing. Whether you are just on private land or in an office building with no business there, or you have been told to leave, it is the same as being in someone's house without their permission. While I won't shoot a trespasser in an open field, you trespass in my home and you'll be shot. I have every right to determine who is in my home or on my property. I will give you one opportunity to leave, and if you refuse to leave, you are arrested. It is that simple.

There are too many scary people out there who take advantage and stalk and be predators to innocent children and families. Too many sociopaths for sure who would cross the line whenever they felt they wanted to.

I agree with you. There should be no private property. How can a person own a piece of the earth?
