Most of the ones worth sneaking into, you can't because they have security checking room keys.
There are a couple of very nice pools that anyone can use. The pool at the Hard Rock which is one of the most popular with the young and beautiful crowd, and the Tropicana also a very nice pool.
You can use these two pools because of the Nevada law which requires a casino to allow anyone to go where they have gaming. The HR and Trop have swim up blackjack tables in their pool. So long as you behave yourself and don't give them a reason to kick you out they have to let you stay.

30 years and mandatory hard labor..lol
No, 99 times out of 100 they would just tell you to leave, and at worst maybe take down your info and threathen to have you arrested if you come back. If you caused a scene and starting yelling at them, they might try to slap you with trespassing or something like that. In reality they would not want to do that though.
Most nicer vegas resorts understand how high the demand is to be by there pool and they know that people are just having fun in Vegas and not trying to cause trouble most of the time.
Be careful though because you just never know.

A reward for being able to pass thier security.
Most of the resorts have the pool area pretty well locked down. Need to show a room key to get a towel, a seat or just in the gate.
Some are now even testing your ke to make sure it works and is registered!!

They probably have a sign somewhere that says you'll be prosecuted to the full extent of the law. However, you can probably say you forgot it or lost it, and if you play it cool you can probably make a sneaky getaway. Keep in mind that if you start going regularly, the employees will recognize you and bust your ***!! So be careful, and have fun ;)

In theory, you could have charges brought for trespassing.
In reality, if discovered, they'd probably toss you out and tell you not to come back. If you did, though, then they might call the police.
Chances are no one will know unless they are very strict there.
