I have a friend whose ex is not paying insurance on child for several years. This was court ordered. The friend is having to pay for insurance for the child. Is this not illegal for the other parent not to pay?

She should take him to court. They can take the money from his checks.

What are you talking about? Financial Support ?
Is that in connection with Divorce Settlement? What is the Court Order? To pay Child Support or just to pay for Insurance coverage? Financial Support is normally awarded until the child reaches 18 or age of maturity. Insurance coverage is a different matter. It may be a part of the Support or in addition to it. If the Court Order is to pay Child Support and not expressly requiring payment of insurance -non-payment for insurance coverage is not a violation of the court order. You must know the Concept of the Court Order. Child Support is for the child's upbringing. Would like to give you more info but you need to be more specific.

Of course it's illegal if he is not paying child support, especially if it was ordered by the court. Either way he owes. She should be taking him back to court. The judge will either garnish his wages until what he owes is paid in full, or he could even have his license taken away. Not paying child support is huge. She should be taking things into her own hands and making SURE he pays for his kid.

Your friend can go to the local family court with the court order and file legal action. If the defendant doesn't show up then the judge will order a bench warrant(the cops pick him up and bring him to court). If that doesn't bring the defendant to court then the judge will order an arrest warrant.
Free legal advise and help for those who qualify will be given through your local legal aid agency. If there is no qualification, your state's barr association has a referral service.

She can pettition the court for contempt and the judge may order for him to pay half or all of it back and then tell him to get insurance.. My hubby's x is supposed to have insurance and yes as another dead beat parent allowed it to lapse over and over for not paying the premium. Too much of a headache! So we got it ourselves! But he should be paying half of all medical bills including perscriptions.. If not tell your fiend to petition the court!

if it was court ordered then they have to pay. have your friend go to a lawyer and show them that they are paying the insurance and not the ex.

Tell your friend to take ex back to court. The ex is in contempt of court.

If he was ordered then talk to the case worker and get a court judgment against him

Go back to the court system and see what they can suggest to your friend.

All the parent making the payment can do is keep up with the payments, keep a copy of the payment and sue the other parent for what he/she made in payments...
