'Iran's Guardian Council which vets new legislation has approved a bill giving women greater rights to divorce their husbands, state radio has reported.
Currently Iranian women are allowed to file for divorce only if they have written permission from their spouse.
Alternatively they have to prove that a husband cannot provide for his family, is a drug addict, insane or impotent.
Women have enjoyed greater freedoms in recent years. However a man can divorce his wife whenever he wishes. Divorce applications are granted to women at the discretion of an Islamic judge on a case-by-case basis.,Such cases usually drag on for lengthy periods and are costly, correspondents say. And the judges are almost all men.
Female members of Iranian Parliament had been pressing for a law clarifying when a woman could seek a divorce.
The 12-man Council of Guardians - a panel of clerics and lawyers tasked with ensuring that new legislation complies with Islamic law - rejected a siimilar bill in September on the grounds of ambiguity."
"In 1997, a prenuptial document to be signed at the time of marriage was approved. The object was to give women the rights they lack in Shariat. The future husband forfeits his rights to polygamy and unconditional divorce. Women can initiate divorce, divide assets and have joint custody of children and child support. All the articles are conditioned. As pointed out by the critics this is only a voluntary contract, men do not have to sign and if they don't there are no legal consequences. The practice so far has failed and most men will not sign the contract. Few gains are made since then. Family courts are back again and divorce is referred to these courts, though the number of courts is very limited. Women can function as judges but do not have the title. Mahriyeh is indexed and linked to inflation. Women are given more grounds for initiating divorce."
"ON DIVORCE 1 - On General Considerations
Article 1133 - A man can divorce his wife whenever he wishes to do so.
Article 1134 - The divorce must be performed in the actual form of utterance and in the presence of at least two just men who must hear the actual form of divorce.
Article 1135 - Divorce must be in clear and precise wording, a conditional divorce is null and void.
Article 1136 - The divorcer must be of legal, must be in possession of his faculties, must intend the act and must be free in his action.
Article 1137 - The guardian of a permanently made person, can divorce the wife of the latter if the interests of the person under his custody allow him to do so.
Article 1138 - The actual ritual utterance of the divorce can be performed by an attorney.
Article 1139 - Divorce is specially appointed for cases of permanent marriage: a temporary wife is relieved from marriage by the expiry of the period of marriage or by waiver of the remaining period by her husband."

The law is that if you get a divorce, you no longer have a husband. After the divorce, you no longer have a husband. The answer to the last one is. I duno. :) arum

Just after the divorce she falls apart and loses her head. She has the right to be scared to death just before the final decree.

Um, well i think there you are basically stuck with someone after getting married there. marrage is a very big deal there and i think if a woman is caught trying to leave an abusive husband she is beheaded or something similar to that. so, basically i think the way that Iran is ran sucks.
