The woman doing my taxes advised me to file taxes jointly with my fiance'. I was wondering if that is illegal? He is also in the military, so I don't want to get into any kind of trouble.

nice job on having doubts about this, because this is definitely not legal. If your not married you cannot claim married filing jointly on your return.

That is wrong, find a new tax preparer. I had a gal in my office the other day and her tax preparer put on her last year's return that she and her husband paid $900 for two of their kids to go to a public school! One of the kids isn't even old enough to be in school! I was so alarmed! What is wrong with these people? They are supposed to be professionals and you should report them just for suggesting the idea!

If you're not married, then yes, it's illegal. I'd stay far away from the woman who's advising you to do this - she'll get you in trouble.
