My ex-girlfriend has custody of our son, I pay child support
EVERY month. In our custody agreement, I get to claim him every other year. This is my year. Since I don't have sole custody of him for more than 6 months, do I get to file HOH or must I file single because his mother has custody? Thanks.

You may be able to file HOH if you had another qualifying dependent living with you...

Even though you can claim him as a dependent, you can't file head of household if he doesn't live with you more than half of the year. So you'll file single.

if you are the only person in the house, then you must file single
