My ex-husband is current in his child support payments, and has made sure of this because he wants to be sure that he is able to claim one of the two boys on his taxes. According to our divorce decree this is how it should be, and I would not have a problem with it except he only seen the boys 2 times last year (one time for an hour and the second time was on fathers day, 24 hrs.) No phone calls on Christmas, birthdays, or any other days to just say hello even. It doesn't bother me (accept my boys really miss their dad) because his current girlfriend does NOT like the children, therefore I don't want them aound her. I don't think it is fair that he is able to claim either one of the boys on his taxes. My child care cost alone is approximately 75% of what I recieve in Child support. Is there anything that I can do?

Under IRS tax laws, in order for either parent to deduct a child , they must provide over 50% of the care for that child themselve. So obviousily, 2 times a year does not this meet. Legally, you are the only one who can deduct the boys on your taxes. A father should spend as much time as he can afford to with his kids cause before he knows it, theyll be all grown up and have no need for him and dad will always regret it. Turn him into IRS if need be. If you dont want to do that then just file the boys on yours and let IRS catch the infraction and theyll demand proof of such and he wont be able to do it so youll be cleared by the IRS. Good luck

Write a letter to your ex explaining the situation and that you needed to be solved.
