I was married to my 1st wife for seven years and we had 3 kids together. When we divorced we decided it would be best to have joint custody with all child expenses and decisions split half and half. It has worked out well for both of us. Now my ex-girlfriend (never married) has my forth child and has filed for child support. I have a court order for joint custody on my first 3 children but neither of us has to pay child support to the other, so does that meant that the forth child will be counted as the first when it comes to the percentage of my wages?

By the way this is all in the state of Illinois Cook County Circuit Court.

It really depends on the state you're in. Some states award between 20 and 27% per child with offsets for multiples. Some states would give you an offset from the 4th based on the first 3. Some don't care and make you pay the max on every kid.

I'd suggest you look up the state family code for where you are and see what it says.

You really need to go to court and find out about this and do what is right by your child.... You need to step up and take care of him as you chose to sleep with someone and create him. If it is joint custody then the one he does not reside with primarily will have to be the one to pay child support.
