Both the Lumiere's and Edison were starting the actual motion picture process at about the same time, the late 1890's, though they'd both been working on the process before then.
As far as copyright here in the states, the first was in August 1893 from Edison called Fred Ott's Sneeze, an employee of Edison. The Lumiere brothers had a public showing of their short filmed scenes of regular life in December of 1895.
Kind of six and one half dozen of the other.
