I WAS TOLD THE OTHER DAY AT MY JOB THAT I CANT BE ON THE FLOOR ANY MORE. IM A SERVER AT A RESTRAUNT. tHEY TOLD ME IT ISINT SAFE, BUT HAVE NO WHERE FOR ME TO WORK UNTIL THE BABY IS BORN. WHAT I DONT UNDERSTAND IS THEY LET THE LAST PREGNANT WOMEN WORK TILL LIKE 3 WEEKS BEFORE SHE HAD THE BABY. ITS NOT FAIR!! I HAVENT CALLED OUT NOT ONCE SINCE IVE BEEN PREGNANT. TE OTHERS CALLED OUT ONCE A WEEK. IS THERE A LAW AGAINST THIS? I LIVE IN MISSSISSIPPI..

Well, it's probably the best thing for you either way. They're probably watching their backs also so that nothing happens to you while you're on the job.

You should seek out some legal advice. This sounds ridiculous. I worked 4 days after my due date and called out the day I went into labor... I worked at a school for kids with behavior disorders and who were physically aggressive. Although I didn't do any physical restraints after becoming pregnant I still worked there! Working in a restaurant is hard work, but certainly not dangerous...

I would ask and find out if it is the company policy or why they are asking you to take a leave of absence. When I started my maternity leave - mine was 2 weeks prior to my due date. My employer said that they would allow me to continue working up until the baby's birth as long as I had a note from my doctor saying that it was okay. I would ask them for the reason behind what they're saying, as long as your doctor says it's ok to continue working, they should allow it.

I would call the labor board in your state and ask. It does not sound right. If you are healthy and you have not had any complications there is no reason why you should be asked to go on leave.

While the employer has a right to worry about their employees' safety, they can't single you out -- what makes it unsafe for you and not for others?

I think it depends on how much gas you have late in your pregnancy. The management might be concerned about the customers' sensibilities.
