This weekend I went out with some friends and yes i drank a little and over the weekend I looked at my online statement and I found that the waitress took like 5 dollars for a tip and the service was not that great. So to sum up this story can they do this and if they cant who can I alert about this overcharge? Right now its the principle of it.

Your first phone call should be to the restaurant. Tell them what happened and offer to show them your statement if necessary. If they don't want to remove the charge, or give you a credit, tell them you will contact your credit company and dispute the charge, and the restaurant will lose the entire amount and not just the $5. And, no, they cannot charge you $5 just because they want to. However, some restautants do have a surcharge for parties larger than 6 or 8 people. But that normally means they automaticallly add an 18% gratuity, not just $5. Call the restaurant and talk to the manager and see where you get with him. Do not give him/her your credit card number over the phone. Tell them you will go to the restaurant to get a $5 credit.

It depends on whether you were part of a large group at a table. In that case most restaurants have a required minimum tipping fee for larger parties. In addition, each restaurant has their own polices on tipping regardless of party size. Most policies are written somewhere on the menu. You should inquire so that you know for next time. All restaurants are different.
Otherwise, if it was just you and a friend or two then the waitress had no right to add that fee to your card. In that case, you should call and talk to the manager and explain that the service was not very good. See what she/he says.
On the other hand, it was only $5.00 and even though you think that her service was not that good, take into consideration how busy it may have been at the time...waitressing is hard work and most waitresses depend on their tips for income.

Contact the buisness, and explain that you think there has been an error in your bill that you noticed on your statement. Let them know that you would be satisfied with a credit to your account. If they refuse contact your bank and request a credit through the credit card... Good Luck!

you can try 2 sue them. i mean why should they get a tip if they were bad service. u need 2 go back 2 that resteraunt and speek 2 the manager about this problem! dont wait for days and days for this. u need to do something about this! and remeber it's ur money! if it were my money, i would do something fast and stop asking questions on the computer about what i should do! it's my money and im gonna do something about it!

Call the restaurant and talk to the manager and tell him what happened. If needed, go and show him your reciept and your cc statement.

Did ANYONE tip her? Are you sure you didn't tip her? Why do you think you shouldn't tip her? If you didn't, and no one did, YOU SUCK. If you go back there, you could get her in alot of trouble, possibly fired.
