He has been with me for 3 years,but recently got taken back to Afghanistan,he wants a divorce,i can't apply to bring him back into they are divorced.I wanted to get him back on a fiancee visa.

we have been together for 3 years and he could'nt divorce her because she would'nt agree.

Easy, if she won't agree and is beating around the bush, then all he has to do is get HIS solicitor to serve her the divorce papers. These are usually hand delivered into her hand by someone from the court (something like that) so that she can then not say, she didn't receive the papers etc etc etc. Only then does she have to take this seriously and has to abide by the rules.
I know this because when my aunt divorced my uncle, he was a complete **** about it and it was only after he was physically handed the divorce papers (by this court person) that he couldn't beat around the bush no more or hold things up.
Get you hubby to speak to his solicitor about this.

How can he be your fiancee when he is still married?? Don´t you have any self respect at all being with a married man for three years and he has made no effort to get a divorce until now? Serves you both right that his wife won´t give him a divorce.
