Not necessarily - you are both minors depending on the state in which you live. You need to look up the statute (law) about what is the age of consent (how old can you be to make your own decision about having a baby?). In some states it is 12.

+ After the age of 16 you can be tried as an adult. But only if your parents take action in the courts!
Also I've heard in some states that both of the underaged children got into trouble for having underaged sex and getting prego!
It just happen to this very young girl a year ago! However, I believe both sets of parents took action in the courts against there own children! Isn't that sick?
But I don't think you should worry about that!

Go get a pregnancy test to find out if you really are pregnant!
I would save alot of worring finding out if you are or not!

If your not pregnant then great cause at the age of 13 and even at the aged of 17 it's just way too young to have baby's!
Raising a baby is alot of work and it takes alot of money too!

If you are pregnant then you will need to talk to your and his parents. And YOU will need to decide what your going to do regarding this baby... Keep It or Put it up for adoption!
How far along do you think you would be?
Because there is a morning after pill that you can take up to three weeks after intercourse. You can go to Planned Parent Hood without your parents consent!
If you are pregnant I would go to Baby your Baby, Wic, and get onto Medicaid so you can go to all of the needed doctors appointments!

I just read some of the other parents answers and some of them made me sick!
They seem to forget that it is there responsibility to make sure that their CHILDREN are not having sex. and if they are then it is just as much the parents fault as it is the children because they are the one in charge of raising and taking care of they children.

No-if he was 18 it would be considered sex with a minor-and then yes he could be arrested and sent to jail.17 is still ok.But come on-you are only 13-what are you doing having sex in the first place?When I was 13 I didn't even think about a boyfriend let alone sex.I guess times have changed and I am only 24.

Depends on where you live. You shouldn't be having sex at the age, protected or unprotected, you know how many diseases there are. You don't have the maturity to take care of a child, you can't even take care of yourself. Your lucky stupidity isn't against the law, if it was you both would be in jail.

i guess it depends on your state but most states are over 4 yrs but if you are not please be more careful i meet my ex at 15 and he was 25 we were together 7 yrs i raised 2 of his kids one from birth and i found out i was 10 weeks on Oct 5 2004 and Oct 8 2004 we split now my daughter is 20 months and he really never sees her but he has a little boy 14 months and he lives with his mom so its hard most guys don't stick around even if they say they will so please you are way to young take a test you can get one at the dollar store because i know you cant ask you parents for 20 bucks with no reason so good luck and maybe you can let me/us know the out come

No because you are both minors, however, STOP HAVING SEX! You are THIRTEEN! you have the rest of your life to be a grown up you shouldn't have to worry about things like this at 13. Seriously, enjoy being a teenager. Unless you are pregnant in which case you will have a lot of growing up to do in not a lot of time.

well for now you guys are both minors although some states would charge and consider 17 an adult. IT is really in the hands of your parents...if they decide to get the law involved hae very well could get in some type of trouble.

probably not in Arkansas or Kentucky, but just about everywhere else that's called statutory rape, and unless your parents are willing to not press any charges, the state will likely lock his dumb *** up for sleeping with a 13 year old. Its unfortunate that they wont lock you up for being dumb enough to have unprotected sex at 13.

What kind of life could you offer a baby at 13-14 years old? Who will be responsible for that child? Who will wake up at 2 in the morning to feed that child? Who will be there for it while you are in school? Will this not yet man step up and take some responsibility?

depends...forget the state. it what the parents will say and how far they are willing to go. jail should be the furthest thing on your mind right now. you need to think about the current situation (if you are pregnant)

\ummm no I don't think he can ause he is not an adult till 18... but your 13 you shouldn't be having sex. thats way to fast if your not pregnant you should stop while your ahead and if you don't then you need to ask to be put on birth control in a hurry
