I know you can have a non smoking building, but this one appears you are not allowed to be a smoker at all.
I am not looking to rent, i came across it the other day in the paper and i was just curious. Seems like it would be discrimination to me.

as i said i am not looking for a place.. I am a smoker in a non-smoking unit. I smoke outside. It is pretty hard to hide ciggarette smoke in a non smoking building. It stinks, even i think so.
Yes I know it is unhealthy. Just seems unfair to me.

Yes it is...I do not allow smokers in my rental unit, and it is perfectly legal. I also go with no animals...period.

The rule of logic is that 'what ever sound logic' is legal.
Smoking is much more hazardous for second smokers.
I always advertise that I would rent my condo to none smokers...
And if a smoker complain against me, I would say to judge that smoking is hazard to my property and me, the insurance company is going to support me and I will win the case.
SO, even, a city By-law does not allow such advertisement, the majority of people have decided to protect themselves, and finally those By-law [IF any left] would be changed.
There is no doubt whatsoever that in this generation the majority are against smoking and in near future in side walks also smoking would be prohibited...

Yes you can. Also, an employer can make being a non smoker a part of a persons qualifications for being hired. Even if you don't smoke on the job, if the qualifications said non smoker, and the employer finds out you smoke, even if not on the job, you can be fired.

i think there just trying to so no smoking allowed/////////they probable believe if u r a smoker u would smoke inside and hide it ...depending on ur state maybe r maybe not discrimination....smokers need to open places where non smokers are band i believe in the rights of non smoker because yes it is not healthy,,,but i also believe in god and the day in bought us in this world he picked the day and the way we will leave it we are just here for the wonderful ride {thank u god}

Yes, you know what I saw on the news last night that they made it illegal (in Indiana) to smoke in a car when ANYONE in the car is under 18 . Is this Russia

I really don't think so, totally legal to me if I were to rent someday a room maybe I'll ask enquires for that. See since this is temporaly arregement future tenants may complain about the smokey smell and this wouldn't be fair to them. .

In California it is the law, so it isn't discrimination.
And the owner of a piece of private property can set any type of covenant or restriction they want, as long as it isn't racial or gender biased. They can say that you can't smoke, can't whistle, no pets, whatever.

yes you can. Smoking is not a protected class under the Fair

yup. if it's a privately owned building the owners can decide that they don't want anyone who smokes. it's similar to saying "no pets"
