You simply file for an uncontested divorce...
If spouse signs / agrees to uncontested divorce then you are fine.
You can get a divorce whether or not spouse signs or agrees..

It ain't that easy, takes some time and effort. But it depends on your state.

1. Go to your local library and there are books on Filing your own divorce, for your state. In it, it has a list of the forms you need, which you can copy. It also examples of how to fill them out.

2. Go to your court house find the civil files section. Ask/tell them you want to know what forms needed to file for divorce.
They will tell you that they can not tell you how to do it. But they show you a case book to look over. In that book each case will have all the forms, the times, and how to file them.
Pick the one that mostly resembles your case/situation and they will copy it for you. You may have to pay a copy fee/per page.
Ask for the blank forms,if any, take all this home, carefully line them up in the order you have to file them. Study them and file them in order.
There is a minimum waiting period in between many of the documents so be patient.
I live in Maryland and have done about 6 for friends.

You can buy kits in some stores fill out the paper work it has to be done correctly and file it with the court clerk which she will give you a date and time to go before the judge, it will save lots of money also you will also have to work out any property issues how they will be divided and so on.Papers will have to be signed by your soon to be ex and notorized so that the court knows he/she was served and is aware of the filing of divorce in case he/she wants to contest it, he has that right to appear.

you can go to the court house and get the paperwork there (ask the clerk ), fill it out and turn in along with the court fees. they should set a hearing date for the divorce.
